EXPERIENCE
 

We are one of the longest established Solicitors in West London, practice dates back to 1947. Some of our Fee Earners are more than 25 years post qualification experience. Our Senior Partner is a Law Tutor/Lecturer and has over 25 years experience in Tutoring and Training Solicitors and other Legal Professionals.

Conveyancing is our specialism. Our Principal and our team have been engaged in all types of Conveyancing for over 25 years. Our mission is to provide accessible and competitively priced legal services to the public. We try to cut off unnecessary frills and expenses. Our terms of business are clear and you know exactly where you stand with us. We do not advertise and mainly get our clients from recommendation by our existing clients. Our client’s satisfaction is our success. We do not use any “small prints”.

   
FEE STRUCTURE
 

We have a range of funding and fee structures available to clients and pride ourselves on our flexibility to discuss, negotiate and agree fees and payment plans taking into account our client’s circumstances. At the start of each matter, you can expect us to provide you an estimate or agreed /fixed figure of the total cost of your case. This will usually be detailed in the Client Care Letter that we will give you. We will also provide you with an outline of the disbursements that you can expect to incur.

   
  Our hourly charge out rate is £300.00 plus VAT (£360.00 per hour). The majority of the work that we do for our clients is charged on an hourly basis. We may ask for monies on account before we commence your work, which means that we shall hold this money in our client account for you until such time as we are authorised to withdraw it in accordance with our professional rules
  Agreed fees

We can offer you agreed fees subject to the work that you instruct us on. Agreed fees are payable subject to Rule 17.5 of the Solicitors Accounts Rules. The amount of an agreed fee is agreed in advance for a particular matter. The scope of the work covered by the agreed fee is also agreed. The agreed fee is not one that can be varied up or down. It is usually payable whether or not the work completes . Agreement of an agreed fee is evidenced in writing between us. Payments to us of agreed fees shall be deposited into our office account as per our professional rules.

 

Fixed fees

Fixed fees are similar to agreed fees, however, they are usually based on estimates and can be subject to the scope of the work involved, therefore, fixed fees may be varied up or down. Of course we will always ensure that we charge you the fixed fee agreed with you.

 

Deferred Payment

Where you are not able to pay our fees but hope to realise money at some point in the future, you may be able to defer payment of our fees until an agreed date.

Insurance

Where applicable, we will always discuss with you, whether or not you are covered for legal expenses in any existing insurance policy that you may have or can obtain following an event. Usually, in cases such as boundary disputes, employee-employer disputes, disputes with planning authorities, we would advise you to check your home or contents insurance policies to check whether you are already covered.

Legal Aid

We do not undertake Legal Aid work. If you are looking for solicitors who offer Legal Aid, the Law Society’s website may be able to assist you with a list of other solicitors.

Mediation and alternative dispute resolution

We appreciate that generally everyone wants to keep legal costs as low as possible. If you have a dispute with someone, before you expose yourself to legal costs, which can be high, we would encourage you to mediate and/or enter into alternative dispute resolution with the other side. Litigation can be expensive and costly in time, especially litigation that reaches court. In our experience, mediation and alternative dispute resolution is cheaper overall. We can assist you in conducting this if you wish.

Our Fee Earners

Our only Fee Earner is Mr. K.W.E. De Silva who is also the Principal and responsible officer of the firm. Mr. De Silva a Sole Practitioner is a Senior Solicitor with over 35 years of practice experience. He specialises in Conveyancing, Commercial work and other non contentious private client work and has an honours degree in Law from the University of London.

In accordance with Transparency Rules we set below fixed costs for the following areas of Law.

 

Residential Conveyancing

(House Sale/Purchase) £850 plus vat for acting on the purchase or sale. If we have to act for the lender there will be a charge of £250 plus vat. In, addition you will have to pay Stamp Duty Land Tax, Land Registry Fees, search fees and other disbursements usually at set price depending on the transaction value.

Time Scale: It will take 3 - 4 months to complete a transaction, however complex cases may take 6 months, simple cases 2 months.

Probate

Our fee for acting on obtaining the Grant and Administration of the Estate would be 2% of the gross value of the estate plus vat and disbursements, if any.

Time Scale: Average time scale is 6 to 12 months, however complex cases could take several years.

Employment Tribunals

Our fee will be charged at the hourly rate of £275 plus vat and disbursements, if any like Court Fees etc. Number of hours for an average case would be in the region of 10 - 12 hours, worth of work. If it exceeds these limits, we shall let you know well in advance and agree fees with you.

Time Scale: depending on nature and complexity of the case.  average cases 6 -12 months complex ones more.

Debt Recovery

Our fee will be charged at the hourly rate of £275 plus vat and disbursements, if any like Court Fees etc. Number of hours for an average case would be in the region of 10 - 12 hours, worth of work. If it exceeds these limits, we shall let you know well in advance and agree fees with you.

Time Scale: depending on nature and complexity of the case.  average cases 6 -12 months complex ones more.

Licencing Application

Our fee will be charged at the hourly rate of £275 plus vat and disbursements, if any County Court Fees etc. Number of hours for an average case would be in the region of 10 - 12 hours, worth of work. If it exceeds these limits, we shall let you know well in advance and agree fees with you.

COMPLAINTS HANDLING PROCEDURE

 
 

Our complaints policy

We are committed to providing a high-quality legal service to all our clients.

When something goes wrong, we need you to tell us about it. This will help us to improve our standards.

Our complaints procedure

If you have a complaint, contact us with the details.

What will happen next?

1.      We will send you a letter acknowledging your complaint and asking you to confirm or explain the details set out. We will also let you know the name of the person who will be dealing with your complaint. You can expect to receive our letter within three working days of us receiving your complaint.

2.      We will record your complaint in our central register and open a separate file for your complaint. We will do this within a day of receiving your complaint.

3.      We will then start to investigate your complaint. This will normally involve the following steps.

·         We will pass your complaint to Mr Edward De Silva, our Client Care partner, within three days.

·         He will ask the member of staff who acted for you to reply to your complaint within 5 working days.

·         He will then examine their reply and the information in your complaint file. And, if necessary, he may also speak to them. This will take up to three days from receiving their reply and the file.

4.      Mr De Silva will then invite you to a meeting and discuss and hopefully resolve your complaint. He will do this within four working days.

5.      Within two working days of the meeting he will write to you to confirm what took place and any solutions he has agreed with you.

If you do not want a meeting or it is not possible, our Client Care Partner will send you a detailed reply to your complaint. This will include his suggestions for resolving the matter. He will do this within five days of completing the investigation.

6.      At this stage, if you are still not satisfied you can contact us again. We will then arrange to review our decision. This will happen in one of the following ways.

·         another partner of the firm will review De Silva’s decision within 10 working days.

·         We will ask our local Law Society or another local firm of solicitors to review your complaint within five days. We will let you know how long this process will take.

·         We will invite you to agree to independent mediation within five days. We will let you know how long this process will take.

7.      We will let you know the result of the review within five days of the end of the review. At this time we will write to you confirming our final position on your complaint and explaining our reasons. We will also give you the name and address of our Customer Complaints Service which is the Legal Ombudsman who can be contacted at www.legalombudsman.org.uk. PO Box 686, Wolverhampton, WV1 9WJ. If you are still not satisfied, you can contact them about your complaint.

If we have to change any of the timescales above, we will let you know and explain why.
